The Criminal Court number 3 of Terrassa has sentenced the owner of a construction company from Salou to two and a half years in prison for the death of a truck driver on the A-2 highway, near Castellbisbal, in an accident that occurred on June 2, 2020.
The sentence places the origin of the accident in a failure that was not accidental. The court considers it proven that the vehicle was circulating with tires in a condition incompatible with safety regulations and that the employer forced drivers to continue working despite complaints about the condition of the trucks.
The judge attributes the accident to a tire blowout outside legal limits
The victim was 41 years old, married, and had two minor children. He died instantly after losing control of the truck due to the blowout of the front left tire, hitting the median and then colliding with an information panel on the A-2, in Castellbisbal.
The judicial ruling establishes that the tires were worn below legal limits. They also had hardened rubber, deformations, and absence of tread, a condition that the sentence directly links to the fatal accident.
Another driver rejected that truck days before the accident
The ruling states that several drivers had complained about the condition of the vehicles. One of them even refused to use the same truck a few days before the accident, a fact that the court incorporates into the proven facts.
The conviction also extends to a supervisor and a workshop operator. Both have received a one-year prison sentence for installing, on the orders of the construction company owner and with the aim of reducing costs, used tires on the steering axles of the truck, a practice prohibited by road safety regulations.
In the same ruling, the judge acquits another manager of the construction company as their participation in the events that led to the driver's death was not proven.
In addition to the prison sentences, the convicted individuals must jointly and severally pay 493,000 euros to the victim's family.
