Fleeing a checkpoint or refusing a breathalyzer test triggers the same criminal offense in Tarragona

The Guàrdia Urbana opened proceedings for traffic offenses in a Tarragona checkpoint. A motorcyclist without a license fled the operation and a driver tested positive for alcohol and refused to repeat the test.

The Guàrdia Urbana of Tarragona opened proceedings at a traffic control on the TP-2031 road, near the cemetery, during the early hours of Thursday, May 14, against two drivers for alleged offenses against road safety. In the same operation, officers first acted against a 48-year-old motorcyclist who fled the checkpoint and then against a 54-year-old woman who tested positive for alcohol and refused to undergo a second test.

The sequence resulted in two different situations within a few hours, but with the same criminal outcome. The man had never obtained a driving license and was intercepted after disobeying police instructions, while the woman registered 0.94 milligrams per liter of exhaled air in the first measurement, and her refusal to repeat it added another alleged offense.

The motorcyclist fled the control and the Guàrdia Urbana intercepted him in front of the university

Officers signaled a motorcycle driver to stop on the TP-2031, but the man ignored the instructions and continued driving. The Guàrdia Urbana located him shortly after on Catalunya Avenue, in front of the university.

Once the vehicle was stopped, the police officers confirmed that the 48-year-old driver had never obtained a driving license. For this reason, they initiated proceedings against him for an alleged offense against road safety.

In addition, the police action resulted in several administrative complaints. The motorcyclist was fined for negligent driving, for disobeying officers, and for driving without mandatory insurance, and a tow truck took the motorcycle to the municipal impound lot.

A driver tested 0.94 and refused the second test around four in the morning

Hours later, at the same checkpoint, the Guàrdia Urbana opened proceedings against a 54-year-old woman. The intervention occurred around four in the morning.

In the first alcohol test, the driver obtained a result of 0.94 milligrams per liter of exhaled air. She then refused to perform the second test required in this type of operation.

That refusal also constitutes an alleged offense against road safety. The intervention was recorded at the same point on the TP-2031 where officers had previously acted with the motorcyclist, near the cemetery.
