The High Court of Justice of Cataluña has confirmed the conviction of two defendants for assaulting and injuring a man on the hill of the Seu Vella of Lleida, in events that occurred on May 5, 2021, in Sardana square. The resolution fully ratifies the sentence issued by the Audiencia de Lleida, which imposed on both 3 years, 6 months, and one day of prison for a crime of injuries with the use of a dangerous instrument and with abuse of superiority.
The assault occurred when the victim was with some friends. The first of the convicted individuals grabbed him by the neck and began to hit him, while other people joined the attack. The second accused also participated in the assault. During the episode, the man received wounds with a sharp object on his neck and abdomen.
They tried to throw him over a wall
The judicial resolution establishes that the aggressors tried to throw the victim over a wall. The man managed to escape and was transferred to the Arnau de Vilanova hospital in Lleida, where he had to be surgically intervened as a consequence of the injuries suffered.
The Prosecutor's Office had accused the two men of an alleged crime of attempted homicide and requested for each of them a sentence of 9 years in prison. However, the Lleida Court finally convicted them for aggravated injuries, a classification that has now been endorsed by the TSJC.
The TSJC endorses the participation of both convicted
The high Catalan court considers proven the participation of the two accused in the aggression based on the victim's account, as well as the statements of police officers and witnesses. It also confirms the concurrence of abuse of superiority, understanding that the group's action left the victim in a situation without options for defense.
In addition to the prison sentence, the TSJC maintains the prohibition of approaching the victim for five years. It also confirms the joint payment of an indemnity of 8,760 euros. The costs of the appeal have been declared ex officio.
The decision of the High Court of Justice of Catalonia is not final and can still be appealed in cassation before the Supreme Court.
