The decision comes after an arrest made by the Guardia Urbana when, in the early morning, they found the investigated person on top of the woman, who was lying on the sidewalk and unconscious, with her pants down. The victim ratified the complaint, explained that she is afraid of the investigated person and also reported physical discomfort.

The events occurred around 4:30 a.m. on Sunday, when a citizen alerted the police after seeing a man next to a woman lying on the sidewalk. Initially, he suspected it might be a robbery.
When patrols arrived at Ramon Llull street, in El Clot, they confirmed that the woman was unconscious and with her pants down. The officers also saw that the man was on top of her, so they proceeded to arrest him.
The case is being investigated as an alleged sexual assault on a woman who could not react at that moment. The arrested person was subsequently brought before the court.
The judge noted witnesses and issued a 200-meter restraining order
In her ruling, the judge stated that there are witnesses who saw the woman unconscious, with her pants down, while the arrested person was lying on top of her and touching her genitals. This account is part of the elements considered before agreeing to release him with charges.
