The Court of First Instance number 1 of Lérida has recognized permanent total disability for a 50-year-old woman diagnosed exclusively with fibromyalgia. The judicial resolution obliges the National Institute of Social Security and the General Treasury of Social Security to pay a life pension.

The amount amounts to 100% of the regulatory base which stands at 1,592 euros per month. The economic effects of this sentence date back their consequences to the moment of the cessation of paid employment and include the corresponding legal revaluations.

A diagnosis without other associated pathologies

The magistracy considers it proven that the plaintiff suffers from cervical and lumbar discopathy in addition to fibromyalgia grade III. The ruling highlights that there are no other concomitant diseases that alone justify total disability for all work.

"The degree of Absolute Permanent Incapacity is granted to a worker affected by fibromyalgia grade III without taking into account any other associated pathology" - Josep Miquel Moragues, lawyer for the affected person

The lawyer for the plaintiff underlines the significance of the verdict by basing it solely on this chronic illness. This criterion breaks with the usual trend of requiring serious comorbidities to grant the maximum degree of social protection.

The medical tests provided confirm the severity of the clinical picture presented by the patient. A report from the rheumatologist dated April 7, 2026, details that the woman presents 18 positive fibrositic points during the physical examination.

A decade of unsuccessful treatments

The judicial rulings establish that the suffering from fibromyalgia dates back to at least the year 2011. The affected person has undergone prolonged treatment that includes physiotherapy, massage, rehabilitation, specific exercises, and analgesia with scarce results.

This clinical situation has prevented his reintegration into the ordinary labor market. The court values the ineffectiveness of the conservative therapies applied for more than fifteen years to mitigate extreme pain and fatigue.

The ruling issued is not final at this time. The parties may file an appeal for reconsideration before the Social Chamber of the High Court of Justice of Catalonia if they deem it appropriate to challenge the judgment.

The local context reflects a complex health reality in the capital of Lleida. Currently, there are more than 10,000 people affected by fibromyalgia in the area, along with between 300 and 600 people with chronic fatigue and between 50 and 70 with multiple chemical sensitivity.

The entity Fibrolleida warns about a notable increase in cases of chronic fatigue linked to the covid pandemic. This phenomenon has modified the epidemiological profile of sick people in the region.

The average age of those diagnosed has experienced a significant decrease in recent years. While before the range was between 45 and 50 years old, it now ranges from 25 to 60 years of age.
