The Provincial Court of Tarragona has confirmed the conviction of nine months in prison for a man caught at the wheel on the C 37, between Alcover and Valls, despite having had his driving license withdrawn for more than a decade. It is the sixth conviction he has accumulated for the same crime.
The events date back to 1:20 hours on May 11, 2024, when the accused was driving a BMW 320D along kilometer 6 of this road. In a control, the Mossos d'Esquadra verified that he lacked a driving license in force.
Permit withdrawn since 2013
The driver had his license withdrawn due to loss of points since July 12, 2013. Even so, he was again intercepted driving, which led to a new criminal proceeding in the Criminal Court 4 of Tarragona, which imposed on him a prison sentence.
The defense appealed that sentence, but the Audiencia de Tarragona has dismissed the appeal and has fully ratified the resolution. The magistrates maintain that they harbor no doubts about the credibility of the mossos who participated in the intervention.
Five antecedents for the same crime
The defendant already had five previous convictions for driving with a revoked license. Those rulings were issued by criminal courts of Vilanova i la Geltrú, Barcelona and Tarragona. Furthermore, the court highlights a relevant fact in the assessment of the case, and that is that he had not served any of the five previous sentences.
In its resolution, the Court considers that the police statements are reinforced by the administrative documentation incorporated into the case and by the accumulation of the accused's antecedents. With that reasoning, the court closes the appeal route and upholds the conviction imposed by the Tarragona court.
