The First Section of the Provincial Court of Lleida has sentenced a man to five years in prison for a crime of sexual assault with penetration. The ruling, which is now final, was issued after a plea agreement was reached between the Public Prosecutor's Office and the defense of the accused.
The facts that motivated the conviction occurred on February 11, 2022, in the municipality of Tàrrega. The court established that the aggressor raped a woman in the home of a mutual acquaintance while the victim was under the influence of narcotic substances.
The agreement reduces the initial sentence
The application of the mitigating circumstance of drug addiction allowed for a reduction in the amount of the penalty compared to what could have been imposed in an ordinary trial. In addition to deprivation of liberty, the sentence includes six years of supervised release for the defendant.
The judicial ruling also establishes long-term protection measures. The convicted person is prohibited from exercising any type of employment that involves regular contact with minors under 15 years of age.
Likewise, a restraining order and prohibition of communication with the victim for a period of ten years is imposed on him. This measure seeks to guarantee the safety of the affected party after her exit from the judicial proceedings.
Victim waives compensation
The assaulted woman decided to withdraw from the criminal proceedings before the final verdict was issued. As a consequence of this decision, she renounced the economic reparation that the Prosecutor's Office had initially requested for her.
The public prosecutor's office had requested 30,000 euros for moral damages. It also claimed an additional 370 euros to cover the damages resulting from the physical injuries suffered during the assault.

The defense attorney plans to file a brief with the court to request the suspension of entry into prison. The central argument of this petition is based on the convict's drug addiction as a way to avoid effective compliance with jail time.
The resolution of the Lleida Court thus closes the ordinary judicial route for this case that occurred in the region of l'Urgell. The finality of the sentence prevents ordinary appeals against the imposed conviction.
