The investigating judge of the Court of First Instance of Lleida, seat number 2, has sent Dino Marcello Miller to provisional, communicated, and no-bail detention for the attempted robbery of a supermarket in the Pardinyes neighborhood.
The arrest came barely an hour after the events and less than a month after his release from Ponent prison. The sequence concentrates the main tension of the case. The Lleida Prosecutor's Office had requested control measures after his release, and the Mossos d'Esquadra, along with other police forces, were already monitoring him when he allegedly reoffended.
The Guardia Urbana arrested him an hour later in Pardinyes
The attempted robbery occurred around 4:00 PM in a supermarket on Baró de Maials street. According to the case file, the accused threatened an employee with a fake gun and fled without taking any items.
An hour later, the Guardia Urbana arrested him on Enric Pubill lo Parrano street, also in Pardinyes. After being brought before the court, the investigating judge ordered his pre-trial detention without bail.
The public defender conveyed the version the detainee gave to the judge. Alejandra Gabàs explained to Segre that Miller said he acted out of desperation after going several days without eating and that he did not want to harm anyone.
"I didn't want to hurt anyone, and I didn't take any money or anything" - Alejandra Gabàs, public defender
The lawyer also stated that her client will not appeal the pre-trial detention order. The judicial resolution is based on his history of recidivism and lack of ties to the community.
He had been released from Ponent on April 16th after serving five years
Dino Marcello Miller was transferred back to Ponent prison, from which he had been released on April 16th. He had then served five years of a 64-year sentence.
Before that release, the Lleida Prosecutor's Office requested control measures. From then on, the Mossos d'Esquadra and other police forces began a non-invasive surveillance of the now-investigated individual.
The new proceedings could result in a sentence of more than three years in prison. This range could increase due to recidivism and previous convictions for serious crimes on his criminal record.
His record includes convictions for two homicides and an assault in Barcelona
Among the defendant's background is a confession made in 1998. He then admitted to having received 18,000 euros and one hundred grams of cocaine for assaulting former police officer Josep Gilart in his bar in Barcelona.
The victim died two years later after becoming quadriplegic. In addition, Miller was also convicted of killing a police officer during a bank robbery and another man in a Barcelona pub.
The judge agreed to pre-trial detention without bail due to his recidivism and lack of ties, and the defendant has already been transferred again to the Ponent penitentiary center.
