The Lleida Court has imposed five years in prison on a man for sexually assaulting a woman in Tàrrega. The sentence is final after the trial was held by agreement between the parties.
The events occurred in the early morning of February 11, 2022, at the home of a friend of the convicted person. The aggressor sexually assaulted the victim inside the dwelling.
Accused denies being a rapist despite admitting the facts
The Public Prosecutor's Office had initially requested ten years in prison and compensation of 30,000 euros for moral damages plus 370 euros for physical injuries. The defense managed to reduce the sentence by half through a procedural agreement.
During the hearing, the magistrate questioned the defendant about his acceptance of the charges. The man responded with a nuance that sought to differentiate his conduct from the criminal label.

After a second question from the magistrate, the man confirmed his agreement with the penalties and the acknowledgment of the facts. The Prosecutor's Office applied the mitigating circumstance of drug addiction, considering that he acted under the influence of substances.
The victim waives all financial compensation
The complainant withdrew from the judicial proceeding and waived the right to exercise civil and criminal action. This decision implies that she will not receive any economic compensation for the damages suffered.
In addition to deprivation of liberty, the sentence includes six years of supervised release. The court also establishes a restraining order of 500 meters and prohibits any type of communication with the victim for ten years.
The defense of the convicted person will now request the suspension of the prison sentence. The main argument will be the defendant's drug addiction to avoid his entry into the penitentiary center.
