The Prosecutor's Office maintains the request for 14 years and 11 months in prison for the accused of killing a man with machete blows in Verges on the morning of August 13, 2022. At the end of the trial, prosecutor Enrique Barata elevated his conclusions to definitive and maintains that the facts constitute a homicide with abuse of superiority and without any mitigating circumstances.

The indictment places the attack at 2:34 hours in front of the restaurant Mas Pi, in Verges. According to the prosecutor, about two hours earlier they had expelled the accused from the establishment for causing problems. Later he returned armed with a machete and the victim came out to try to calm him down.

The accusation maintains that there were two stab wounds

During that conversation, always according to the prosecutor's thesis, the accused dealt the victim two stab wounds. One in the shoulder and another in the neck. The man died hours later in the hospital.

The Prosecutor's Office considers that there is abuse of superiority and does not appreciate any mitigating circumstance. With that approach, Enrique Barata has fully ratified his request for conviction.

The private prosecution raises the sentence to 20 years

The private prosecution, exercised by lawyers Xavier Sureda and Àngels Alegre, demands a sentence of 20 years in prison. Their thesis is more serious than that of the public prosecutor, as it maintains that it was a murder because the attack was treacherous and the victim had no possibility of defending themselves.

The defense admits the homicide and asks to reduce the sentence

The defense, led by lawyer Carles Monguilod, admits the homicide. However, it requests that the sentence not exceed 10 years in prison.

His argument is that the accused was drunk, was obsessed, and had affected the volitional capacity by a personality disorder. On that basis, he proposes a reduction of criminal responsibility against the requests formulated by the prosecutions.
