The judge of court number 3 of the Section of Violence against Women of the Court of First Instance of Barcelona has ordered provisional detention without bail for a 25-year-old man arrested as the alleged perpetrator of a rape of a woman in the Mossèn Costa i Llobera Gardens, on Montjuïc mountain.

The aggression being investigated dates back to February 13 and places the events in this landscaped area of Barcelona. The arrested man was already in prison and, allegedly, committed the attack while enjoying a prison leave. The arrest took place at the Quatre Camins Penitentiary Center, where the man was incarcerated.

Assault in a secluded area of Montjuïc

According to the investigation, the suspect would have assaulted the victim from behind around midday, would have dragged her to a secluded area of the premises, would have beaten and sexually assaulted her. After the individual's escape, the woman was able to ask for help.

The victim was urgently treated at a hospital after the assault. The formal complaint was not filed until several days later, when the woman was recovering. Even so, the Mossos d'Esquadra maintain that they already had knowledge of the events before that complaint.

Sexual offense record

The detainee had been previously convicted for other sexual offenses. He entered the penal enforcement system in 2018 for acts related to sexual freedom committed when he was still a minor.

Since then, the inmate had been able to access prison permits under the terms provided by prison regulations. The new case is now under judicial investigation, while the accused will remain in provisional prison awaiting the evolution of the procedure.
