A court upholds a restraining order for two minors investigated for assault. The victim crosses paths with them daily in the municipality while the appeal has been unresolved for seven months and the mother demands protection.

The Juvenile Court number 5 of Barcelona maintains a restraining order of five meters for two 14-year-old adolescents investigated for a sexual assault in Gironella, in Berguedà.

The victim's family crosses paths daily with the minors in a municipality of 5,000 inhabitants and one of them lives a few meters from the girl.

The court has not yet elevated the appeal filed seven months ago

The defense of the minor filed an appeal seven months ago that has not yet reached the Barcelona Court for its resolution.

The lawyer for the prosecution requests the commitment of the two defendants to a closed-regime facility until the trial or, alternatively, that the restraining order distance be increased to 500 meters.

The appeal also states that the victim has a recognized disability of 37% and that the two teenagers took advantage of this circumstance and their numerical superiority to make her drink alcohol.

The Mossos d'Esquadra arrested the two minors under 14 years of age and the court also imposed a communication ban on them.

The minor received healthcare on two occasions after the events. An ambulance attended to her when she returned home and another intervened again the following day, when her mother reported what had happened at the police station.

It also explains that he has notified the Mossos d'Esquadra about the 12-year-old minor who, he says, points at and harasses the victim in the park, but cannot be charged due to his age.

"I have warned the Mossos d'Esquadra, but they can't do anything because he cannot be charged," T. recounts about that minor.

The two accused, aged 14, have been transferred to an educational center in Manresa, so they no longer coincide with the victim at the institute.

The minor receives psychological and emotional treatment in Berga since the events occurred.

The Girona City Council condemned any form of sexist violence and conveyed its support to the victim and her family following the complaint.

Neighbors of the municipality gathered in front of the institute to condemn the sexual assault and reject the agreed-upon judicial measures.

The aggression allegedly occurred near the Llobregat river on October 18 of last year, when the minor consumed alcohol with the three adolescents and they took advantage of her in a dizzy state to sexually assault her; afterwards, two of them took her to a house where they repeated the assault.

"I only ask that they leave her alone, while waiting for justice to be done," highlights the minor's mother.
